The terms and conditions herein shall constitute the entire agreement between you and Target Markets Ltd for our property Sourcing services. Any modification to these conditions will be binding only if it is evidenced in writing signed by a director of the company and such evidence contains specific reference to those conditions being modified. We reserve the right to decline any order, registration or subscription without giving any reason.
Information: Although every effort is made by Target Markets Ltd, its agents, associates or employees to verify information given in their web site, brochures, and promotional material, it must be clearly understood that such information does not form part of any contract or offer. Any intending purchaser of a property or a business must satisfy themselves as to the correctness of any information either printed or verbally issued by Target Markets Ltd, its agents, associates or employees.
Details: Target Markets Ltd, its agents, associates or employees make every effort to keep up to date the information stated in its web site, brochures and other promotional material, but it cannot guarantee that particular a property will still be available for sale when prospective purchasers enquire or travel to view. Vendors may increase or decrease the price of properties and no guarantee is given that the price shown in the Target Markets Ltd web site or brochure will remain accurate. Target Markets Ltd reserves the right to make changes to the information and price of content on our website at any time without notice.
Availability: Target Markets Ltd its agents, associates or employees does not accept any liability to interested purchasers resulting from their inability to view properties in which they may be interested due to the fact that the properties may no longer be available for sale, or due to revision of purchase prices, or due to unforeseen circumstances.
Services: All related services offered, such as finance, mortgages, insurance, Currency exchange, legal and tax advice, removals and any other service from a third party – are merely recommended in good faith only and all agreements and contracts with such parties or for such services are entirely the responsibility of the buyer/user and service provider and not the liability or responsibility of Target Markets Ltd.
Currency exchange Rates: Be aware that currency fluctuations can greatly affect the price you pay in sterling for a property when you come to pay for it. We advise you to keep this in mind and seek professional help when transferring money abroad. Note also that properties are often listed in their ‘local’ currency and therefore a sterling price is often only a guide.
Business liability: Target Markets Ltd its agents, associates or employees operate as an introducing agent to assist interested persons in finding and purchasing properties. Target Markets Ltd is not liable for any loss which you may incur for any reason whatsoever resulting from your interest in purchasing, attempted purchase or actual purchase of a property overseas.
Measurements, tenure & usage: Land, property and room sizes provided by Target Markets Ltd its agents, associates or employee’s web site, brochure or any promotional material are subject to survey. It remains the responsibility of the purchasers to satisfy themselves as to the correctness of such information. Building plots described in the Target Markets Ltd web site, brochure and promotional literature remains the responsibility of purchasers of plots of land to acquire/check all necessary planning consents and licences. Title and tenure is also the liability of the buyer, lawyer and selling company and Target Markets Ltd recommend that the services of a professional are employed when purchasing property overseas.
Viewing & Travel: All contracts for transport by rail, sea, air or on land, for accommodation, board and lodging, for legal and estate agency services, or for any other associated services shall be deemed to be contracts between the person/s travelling and the service provider Target Markets Ltd its agents, associates or employees makes every endeavour to recommend only reliable and reputable providers of transport, accommodation, legal, estate agency and other services and shall not be held responsible or liable for any loss or damage resulting from such recommendations.
How Target Markets Ltd get paid for their service: Target Markets Ltd act as a property sourcing company. In order to purchase a property through Target Markets Ltd, you will pay us a property sourcing fee. Fees can vary from deal to deal and will be payable upon reservation of any property. All fees paid to Target Markets Ltd are non-refundable for any reason. It is the responsibility of the purchaser to ensure that they are in a position financially and legally to purchase any reserved property. Target Markets Ltd strongly urges all purchases to obtain legal and financial advice as well as conducting all independent due diligence to satisfy themselves of their ability to purchase and their wish to purchase any available property before paying any fees or making any property reservation. Target Markets Ltd may also be paid a commission form property development companies, sales agents, removals companies, furniture pack companies, legal or financial companies or any related services.
Property Sourcing Fee: The property sourcing fee which you pay to Target Markets Ltd upon reservation of a property is purely for the sourcing of the property. It is not deductable from the price of any property and is non-refundable. For some property deals the sourcing fee may include the services of a mortgage broker and or legal fees. These services are optional and you are not obliged to use the services of these recommended companies. The property sourcing fee remains the same whether or not the offer of these services is taken up. These services shall be performed by third party companies. Any company recommended by Target Markets Ltd, whether or not included in the property sourcing fee, are recommended in good faith. Target Markets Ltd accepts no liability for any grievances or any disputes between you and the introduced company. Should your property purchase fail to complete for any reason whatsoever the Target Markets property sourcing fee is non-refundable as this is paid to us for the initial sourcing of the property only.
Property Sourcing Fees- Continued:
For each property you purchase, Target Markets Ltd will charge you a property sourcing fee. This fee is purely for the sourcing of the property and is paid upon reservation of a property. We cannot guarantee that the property is suitable for purchase and all properties are sold subject to contract. Whilst we will do all that we can to secure you properties that are suitable for purchase we cannot be held responsible for properties that turn out to be unsuitable. The provision of services beyond this should be considered outside our agreement and do not form part of the agreement between Target Markets Ltd and yourself or any third party. We do however in the spirit of cooperation undertake to support you throughout the process and this can sometimes mean that we will provide services at no costs after reservation of the property.
Property Sourcing Fee- Deposits: For some property investment opportunities, Target Markets Ltd will need to pay a deposit or holding fee to a third party agent/developer in order to reserve the property you have chosen. Any such reservation fee shall be paid from the property sourcing fee which you have paid to Target Markets Ltd. Any reservation fee paid to the third party agent/developer is repayable to Target Markets Ltd upon completion of your property purchase, by you. If this fee is deducted from the property price or is used towards your property purchase in any way then you will be required to pay Target Markets Ltd this amount upon completion of your purchase. Payment of this amount is to be paid no more than thirty days after notifiacation is sent to you by Target Markets Ltd, after completion of your purchase (whether or not the build is complete). Associated companies actions: Target Markets Ltd its agents, associates or employees shall not be held liable or responsible for the actions of other persons or companies or firms with which it may be associated or have connections with.
Building time on new property: Whilst every effort is made by Target Markets Ltd its agents, associates or employees to give accurate information to purchasers of “off plan” properties as to the building time of such properties it must be clearly understood that purchasers contracts are with the relevant construction company and not with Target Markets Ltd its agents, associates or employees .Estimated building times are given by the relevant construction company and it should be clearly understood that delays or changes may occur. Target Markets Ltd its agents, associates or employees accepts no responsibility for any such delays or changes.
Access and use of the Target Markets Ltd Websites and content: All materials, logos, pictures and content on Target-markets.co.uk and other owned websites within our group are the sole ownership of Target Markets Ltd and cannot be used by other parties in any way unless by consent.
In the event that a particular transaction does not become a Sale and the client wishes to cancel the property at their own decision Target Markets Ltd cannot be held liable for the return of any deposit or payments agreed and paid to the agent or developer and this is to be the responsibility of the purchaser or customer to follow up direct with the developer or agent that issued their contract for the property.
Re-selling: If a property has been purchased with a view to re-selling please note that Target Markets Ltd its agents, associates or employees do not guarantee selling properties prior to or after completion, nor do they guarantee any profits or returns, and have no control over the future volume of purchasers, their requirements or future market conditions. Target Markets Ltd its agents, associates or employees does not require exclusivity to market re-sale properties and in fact in many cases cannot deal with such resale’s, and purchasers are free to market their properties themselves or through Estate Agencies of their choice and Target Markets Ltd may or may not offer to assist. It is also important to understand that reselling overseas property will be subject to a fee and these charges can vary considerably - Target Markets Ltd its agents, associates or employees accept no liability for any agreements by these companies as we only help you to market these properties through our agents and associates throughout the world. If we do agree to assist in the resale of a unit purchased through Target Markets Ltd we will do so through our own contacts only and we do not in any way guarantee to be able to re-sell a unit for any investor. Any attempt will be made in good faith and an agreed fee will be payable upon the completion of the sale.
Post agreement to purchase queries: Target Markets Ltd its agents, associates or employees operate only as an introducing agency to assist interested persons in finding and purchasing properties from a range of developers, agents and associates. All future customer queries regarding the property purchased are dealt with by the developer or agent who issues your contract. All legal queries should be directed to the lawyer you have appointed and not TargetMarkets Ltd. its agents, associates or employees.
Data Policy: When registering with Target Markets Ltd for the purpose of finding an overseas property, personal details such as name, address, email and phone number will be required. This data may be passed on/shared with our associated overseas companies and developers and this is essential in assisting a customer looking to buy a property. If a client does not wish to have their information passed to a third party they must request this and Target Markets Ltd will comply.
Contact information: Target Markets Ltd its agents, associates or employees do not accept liability form any client, who has not informed the developer or agent, from who the builders contracts are made out from, regarding new change of address or contact details. If the developer cannot contact the client through the present details they have on file and no evidence of informing the developer of the new address is provided, then the client is at risk in losing the money invested in the property and the property itself.
Additional services: Target Markets Ltd its agents, associates or employees operate as an sourcing and introducing agent only and do not organise NIE numbers, bank accounts, mortgages, power of attorney, immigration advice, etc…for clients. It is up to the client themselves to organise all of these, either with their appointed lawyer or if written confirmation has been given, by the developer or agent they have purchased with. Purchaser's Responsibility:
It is your responsibility to confirm that you are in a position to obtain financial products and services to proceed with any property purchase. Target Markets Ltd acts as a property sourcing agent only and is not responsible for the arranging of or assisting purchasers with the arrangement of any loans or financial products. We strongly advise all purchasers to seek proper financial and legal advice before proceeding with any purchase and to make sure that any financial products are available to you. Reservation fees, property sourcing fees and fees associated with costs which are paid to Target Markets Ltd by purchasers are non-refundable for any reason and as such should not be paid until you have carried out full due diligence for each investment and have satisfied yourself as to your ability to purchase any property sourced by Target Markets Ltd. All investment figures and deal structure examples contained within the Target Markets Ltd marketing materials are meant for guidance and marketing purposes only. It is your responsibility to source and secure any financial products which you deem necessary in order to complete on a property purchase. We can introduce you to companies to assist you with all aspects of property investment but it must be understood that such introductions are made in good faith only and you will enter into separate contracts with those companies which are introduced. Property deals may offer incentives or special offers by third party companies such as property development companies etc. It is your responsibility to carry out your own property valuation, due diligence and any other legal or financial research and diligence required in order to assess the benefit of any special offer or incentive such as discounts or contributions or rental guarantees or any other incentive offered by any third party company.
You must proceed with your purchase in a timely manner. Any agent /developer from whom we source property investment opportunities shall have the right to re-sell any property reserved by you if you do not proceed with the purchase in a timely manner. You must remain contactable for communication to progress your purchase. If neither Target Markets Ltd or the developer/agent are unable to contact you for a period in excess of one month and you do not respond to email or telephone communication, the agent/developer shall be at liberty to re-sell the property reserved by you. Target Markets Ltd shall also be at liberty to re-sell your reserved property to another investor. Please do not reserve any property investment if you are unable to dedicate the time to progress the purchase through to conclusion. Property sourcing fees will not be refunded in such instances.
Allocation of monies received
Any money received will be allocated to any expenses owed followed by property sourcing fees.
Referrals and Follow-Up
Your details will never be sold or passed on to any third party without your prior permission unless you have purchased a property. In this case, your details will be referred to various third parties to supply a number of different services including mortgage broker, solicitors, letting agents, curtains, furniture and flooring contractors. You further give us permission to discuss particulars of these services with the relevant third party.
Provision of Service
We make no promises that our content or the service itself will be delivered in an uninterrupted, timely, secure or error-free fashion.
Claims and Guarantees
You agree that all photos and figures quoted are for illustrative purposes only and that it is up to you to conduct sufficient due diligence and research into the property including seeking competent authority prior to making any financial decision, this includes undertaking a property valuation, researching the area and market rent. We make no claims as to the specification of the finished property. You will need to refer to the builder’s specification sheet for the individual plots. We have given you no guarantees. You are aware that property values and rents can go up as well as down and that if you do not keep up payments on loans or mortgages secured on your property it may be repossessed.
No decisions, No responsibility
You agree that Target Markets Ltd, its directors, employees or shareholders have given no advice, they have only relayed their own personal experiences and those of its employees and clients in property. You further agree that you have made all decisions and take full responsibility for those decisions. In the case where you had questions or were unsure you consulted with competent authority and that those questions have been answered to your full satisfaction.
Costs incurred in buying a property
Target Markets Ltd cannot be held liable and accepts no responsibility for any costs associated with the purchase of property sourced through Target Markets Ltd. Target Markets Ltd is responsible solely for the referral of the property. Should a property a client is purchasing not proceed for any reason the client will be responsible for meeting all the costs involved and will have no claim against Target Markets Ltd.
Claims
Advice of damage, delay or partial loss of goods in transit or of non-delivery must be given in writing to us and the carrier within three working days of delivery (or in the case of non-delivery within 28 days of dispatch of the goods) and any claim in respect thereof must be made in writing to us and the carrier within seven clear days of delivery (or in the case of non delivery, within 42 days of dispatch). All other claims must be made in writing to us within 28 days of delivery. We shall not be liable in respect of any claim unless the aforementioned requirements have been complied with except in any particular case where the customer proves that (I) it was not possible to comply with the requirements and (ii) advice (where required) was given and the claim made as soon as reasonably possible.
Limitation of Liability
The sole liability of Target Markets Ltd in respect of any defect in, or failure of any goods or services supplied or for any shortage in the quantity of goods delivered or for any loss, injury attributable directly or indirectly thereto (other than in respect of death or personal injury) is limited to i) making good by replacement or ii) repairing defects or failures which under proper use appear therein. Without prejudice to the foregoing, Traget Markets Ltd shall in no circumstances be liable - i) for any indirect or consequential loss (including without limitation loss of production, loss of profit or liability to third parties) suffered or incurred by the customer. ii) for any loss or damage in excess of the contract price for the goods or part thereof in respect of which a claim is made. We shall not be liable for any loss to the customer arising from any delay in transit.
PLEASE NOTE: Target Markets Ltd and their partners, affiliates, officers, employees, agents, contractors, successors and assigns do not accept any liability for any investment decisions made on the basis of, arising out of, or in any way related to, the use of information contained in our marketing publications and emails. The information and services provided by Target Markets Ltd do not constitute financial, investment or tax advice and should not be taken as such. Target Markets Ltd urge you to obtain professional advice before proceeding with any investment. Target Markets Ltd are not licensed investment advisors or licensed estate agents. Target Markets Ltd are not authorized by the Financial Services Authority to provide investment or financial advice.

Except as expressly provided in this Agreement, all of the content on this site is the property of Target Markets Ltd and is protected by UK and international copyright laws. “Content” means any information, mode of expression, or other material and services found on the www.target-markest.co.uk website, printed matter or any other form of communication from Target Markets Ltd. This includes discussion boards, chat, software, our writings, graphics and any and all other features found on the site.
Force Majeure
We shall be under no liability if we shall be unable to carry out any provision of the contract for any reason beyond our control including (without limiting the foregoing) Act of God, legislation, war, fire, flood, drought, failure of power of supply, lock-out, strike or other action taken by employees in contemplation or furtherance of a dispute or owing to any inability to procure materials required for the performance of the contract.
Law
These conditions and all other express terms of the contract shall be governed and construed in accordance with the laws of England.
